Terms of Service

Effective Date: March 15, 2026

By accessing or using Whisperly ("we," "our," "us," or "the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use Whisperly. By creating an account, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms. We reserve the right to terminate accounts where age misrepresentation is suspected.

2. Account Registration

You must provide a valid email address to register. You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us immediately at support@whisperly.fun if you suspect unauthorised access.

3. AI-Generated Conversations

Whisperly uses artificial intelligence to generate conversation responses. AI-generated content is provided "as is" and may not always be accurate, coherent, or appropriate. We use Together AI to power conversations. By using the Service, you acknowledge that message content is processed by this third-party AI provider.

You retain ownership of the personas and characters you create. However, by using the Service you grant us a limited licence to process your inputs solely for the purpose of generating AI responses.

4. Voice Feature

Premium users with voice credits may enable voice responses. Voice synthesis is powered by ElevenLabs. When voice mode is active, the text of AI responses is sent to ElevenLabs for audio generation. By enabling voice, you consent to this processing.

5. Prohibited Content & Conduct

Zero Tolerance: Sexual Content Involving Minors

Whisperly has a strict zero-tolerance policy for any sexual or romantic content involving minors. The following are absolutely prohibited, without exception:

  • Any attempt to generate sexual or romantic content involving characters described or implied to be under 18 years old
  • Any attempt to describe an AI character as a minor, regardless of how the request is framed (including fictional or roleplay contexts)
  • Using phrases such as "it's just a story" or "she's actually 18" to circumvent this policy — these are not valid overrides

Violations will result in immediate permanent account termination and may be reported to relevant law enforcement authorities and the National Center for Missing & Exploited Children (NCMEC) or equivalent bodies in your jurisdiction.

Additional Prohibited Conduct

The following are also strictly prohibited on Whisperly:

  • Content that constitutes or facilitates real-world harassment of identifiable individuals
  • Non-consensual scenarios presented in an approving or instructional manner
  • Hate speech, discrimination, or content targeting individuals based on protected characteristics
  • Any activity that violates applicable laws or regulations

Violation of these rules will result in immediate account suspension and permanent termination. We may report violations to relevant law enforcement authorities where required by law.

6. Subscriptions

Whisperly offers monthly and annual Premium subscription plans. Subscriptions are billed automatically on a recurring basis. You may cancel at any time; your Premium access will remain active until the end of the current billing period, after which your account will revert to the free plan.

7. Credits & Day Passes

In addition to subscriptions, Whisperly offers one-time purchases including message credit packs, voice credit packs, and day passes (temporary premium access). These are separate products from subscriptions and are governed by the same payment terms.

Message and voice credits do not expire. Day passes begin immediately upon purchase and stack with any remaining active pass time. Credits and day passes are tied to your account and cannot be transferred.

8. Payments & Refunds

All payments are processed securely by Stripe. Whisperly does not store or handle your payment card details directly.

All purchases are final and non-refundable. This applies to subscriptions, message credit packs, voice credit packs, and day passes. If you believe a charge was made in error, contact us at support@whisperly.fun and we will investigate.

By making a purchase, you also agree to be bound by Stripe's terms of service. Any disputes regarding fraudulent charges or unauthorised card use must be resolved with your payment provider. Whisperly is not liable for losses resulting from unauthorised payment activity.

9. Intellectual Property

The Whisperly platform, brand, design, and software are owned by us and protected by applicable intellectual property laws. You may not copy, reproduce, or redistribute any part of the Service without prior written permission.

10. Limitation of Liability

To the fullest extent permitted by law, Whisperly and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including reliance on AI-generated content. Our total liability to you for any claim shall not exceed the amount you paid us in the 30 days preceding the claim.

11. Termination

We reserve the right to suspend or permanently terminate your account at our sole discretion if you violate these Terms, engage in harmful conduct, or for any other reason with or without notice. You may delete your account at any time by contacting support@whisperly.fun.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. Continued use of Whisperly after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
